      Andrzej Bargiel Sport Promotion leads retail sales via the Internet. Orders are placed only by websites available at the domain www.suntleones.com. A sales agreement is concluded between a person placing an order (Client) and the Company Andrzej Bargiel Sport Promotion a (the owner of the shop).

       

      The Company Andrzej Bargiel Sport Promotion works according to the rules of concluding and withdrawing agreements on providing services by electronic means: Polish Code of Civil Procedure of 17th November 1964 (Journal of Acts Dz. U., No. 43, item 296 with subsequent amendments) Providing Services by Electronic Means Act of 18th July 2002 (Journal of Acts Dz. U., No. 144, item 1204 with subsequent amendments), Consumers Rights Act of 30th May 2014 (Journal of Acts Dz. U., No. 8 and next, item 827 with subsequent amendments), Minister of Internal Affairs and Administration Regulation of 29th … 2004 (Journal of Acts Dz. U., No. 100, item 1024) concerning the documentation of personal data processing as well as technical and organizational conditions which should be met by devices and computer systems used for personal data processing. Placing orders via the Internet is possible on condition that the Client’s ICT system meets the minimum requirements: operating system: Windows, processor: 1 GHz, RAM: 1 GB, hard disc: 8 GB of free space, graphics card:256 MB managing 1024×768 screen resolution, control: keyboard, mouse, etc., Internet connection: minimum bandwidth: 512 kbit/s for downloading, 128 kbit/s for sending; Internet browser with Java Script, e.g. Google Chrome, Mozilla Firefox.

       

      • 2 Registration and Personal Data Protection

      While placing the order, the Client gives his personal and contact data to:

      – confirm and complement the order;

      – get e-mails about the status of the order.

      Providing personal data by the Client and the Client’s consent for data processing are necessary to complete the order by the shop www.suntleones.com . Every Client has the right to inspect, correct and delete provided data. Sending marketing offers by electronic means and trade information will be possible only after separate agreement.

       

      • 3 Items and Goods

      All products available at the site www.suntleones.com are brand new, manually and legally faultless. The Internet shop is obliged to provide the Clients with brand new, faultless goods.

       

      • 4 Procedure of Placing Orders

      Orders are placed on the website www.suntleones.com. The purchase of an item is made through adding the selected product into the basket and then, filling in the order form and confirming it by using the button “kup” (“buy”). Properly placed order is immediately confirmed with an e-mail (or with a phone call in some particular cases) automatically sent by the sales system of the shop to the address indicated by the Client. The execution of the order starts after receiving the full payment by the shop, in most cases within 24 h. Purchased goods are delivered by courier companies. The agreement concluded by the Client and the Company referring to the selected goods purchased in the Internet shop is with a fixed time and lasts for the execution of the order time. The place of fulfilling the service referring to the products purchased in the Internet shop www.suntleones.com is the delivery address indicated by the Client. Orders are executed from Monday to Friday. The execution of orders comes after according to the succession of orders, till the stock unavailability covered by this form of sales in the warehouse of the shop. The shop reserves the right to conduct promotional campaigns and sales in accordance with the current terms of use within this field. A limited number of goods is intended for promotional sales. The above privileges do not affect prices of the goods within orders placed before the date when the change comes into force; the conditions of special offers and sales. Special offers in the shop cannot be combined unless the terms of use state differently.

       

      • 5 Payment

      The Client is obliged to pay the price for the ordered goods, including delivery fees, not later than within 7 days from the date of concluding the agreement.  In case of lack of payment for the ordered goods within 7 days from the date of concluding the agreement, the shop will cancel the placed order. The Client will be informed about that through sending a message for an email address given by the Client during the process of placing the order. Payment is made through traditional transfer. A sales receipt or an invoice is enclosed to the order. Prices presented in the shop are gross prices. The seller informs that he is legally exempt from VAT. All prices are provided in PLN. The price specified next to each product is binding upon placing an order by the Customer.

      • 6 Delivery and the Execution of Order

      The processing time (the time of delivering the parcel) is the time from the moment of posting the Client’s payment to the moment when the Client (or the person indicated by the Client) becomes the owner of the order. Total processing time = (confirmation of payment + preparation + packing + sending +delivery time): from 3 to 7 business days. In case of notifying shipments the processing time may extend to 14 days. The orders from the shop are sent to the regional carrier only on business days. The Internet shop www.suntleones.com is responsible for the order during every stage of its execution.

       

      • 7 Returns, Exchanges, Complaints

      You have the right to withdraw from this agreement without stating a reason within 14 days from the date of the receipt of the order. The deadline for withdrawal from the agreement expires after 14 days from the receipt of the order. You are obliged to inform us about your decision regarding withdrawal from the agreement in a form of unambiguous statement (e.g. a message sent by post or by email). In order to maintain the time of withdrawal from the agreement, it is enough to send information regarding the execution of your right to withdraw from the agreement before the deadline for withdrawing from the agreement. In case of withdrawal from the agreement, we refund full cost paid for the Goods. Immediately, anyway not later than 14 days from the day when we were informed about your decision regarding withdrawal from this agreement. Return of payment will be done by using the same method of payment, which You used during the primal transaction unless You agreed clearly with a different solution.  A person who withdraws from the agreement bears the cost of return shipment. We can wait with the refund of money until the moment of receiving the goods or providing us with the evidence of sending it back depending which action will be earlier. You are asked for sending back or delivering the item immediately, anyway not later than within 14 days from the date when you received the parcel. The deadline is maintained if You send the item before the end of 14 days. In case of refund of the product equivalent price and costs of sending defective goods back, we will use the same method of payment, which You used during the primal transaction unless You agreed clearly with a different solution. The Internet shop www.suntleones.com allows for exchange of purchased goods within 14 days from the date when the item was issued. If a product from our shop will not fit or suit, You are allowed to exchange it for a different one in the same price or to pay a difference in case of a more expensive item.

      – specifying the desirable item (what would You like to exchange the previous item for?);

      – providing us with the address for return shipment;

      – enclosing the receipt or the copy of the invoice. Sending already mentioned information via email is also allowed.

       

      The shop www.suntleones.com is obliged to deliver brand new faultless goods to the Client. In case of recognition a product defect, the Client has a right to make a complaint. In such case the Client should send the goods back to the address:

      The receipt or confirmation of transaction regarding the complained goods with a description of complaint should be enclosed to the products, which are supposed to be send back. The answer to the reported complaint will be given not later than within 14 days. The Internet shop www.suntleones.com will respond to the reported complaint and in some justified cases, will refund the Client the equivalent price of the item or will exchange and send the brand new faultless goods within 7 days.  The costs related to sending the complained goods back the shop refunds after consideration of the claim.

       

      • 8 Admonition

      The right of withdrawal from the off-premises or distance agreement does not apply to the following agreements: 1) services agreement, if the Company has provided a full service after the definite acceptance of the Client who, before the commissioning of the service, had been informed that after providing the service by the Company, he will lose the right of withdrawal from the agreement; 2) the agreement where the price or the remuneration depend on the fluctuation on the financial market, over which the Company has no control, and which may occur before the deadline of the withdrawal from the agreement; 3) the agreement whose object are non-prefabricated goods, manufactured according to the Client’s specification or aimed to satisfy his individual needs; 4) whose object are perishable goods or goods with short expiry date; 5) the agreement whose object are goods in a sealed package and which, upon unpacking, may not be returned to the Company due to health and hygiene reasons, if the package has been opened after the delivery;  6) the agreement whose object are goods which, after the delivery, become inseparable with other goods due to their character; 7) the agreement whose object are alcoholic beverages, whose price has been set when concluding the agreement and whose delivery may be done no sooner than after 30 days and whose price depends on the fluctuation of the market, over which the Company has no control; 8) the agreement where the Client clearly demanded from the Company to come and make urgent repairs or do urgent maintenance works; if the Company provides extra service to this that the Client demanded or if the Company delivers goods different than those necessary to perform the repairs or maintenance works, the Client has the right of withdrawal from the agreement with relation to these services or goods; 9) the agreement whose object are sound or video recordings, as well as computer programs delivered in sealed package, if the package has been opened after the delivery; 10) the agreement about the delivery of journals, periodicals, and magazines, except for the subscription agreement; 11) the agreement concluded by public auction; 12) the agreement about accommodation, different that for residential purposes, transportation of goods, rental of cars, gastronomy, leisure-related services, events related to entertainment, sport, and culture, if the agreement names the date or period of providing the service; 13) the agreement about the delivery of digital content which are not recorded on a tangible storage device, if, after the definite acceptance of the Client, the service has started to be performed before the deadline of the withdrawal from the agreement, and after informing the Client about the loss of the right for the withdrawal from the agreement.

      Any dispute between the Client and the Company will be settled by the proper court of law, according to the Polish Code of Civil Procedure of 17th November 1964 (Journal of Acts Dz. U., No. 43, item 296 with subsequent amendments). The Client-consumer has the right to settle the dispute and claim compensation outside of the court of law (the regulations concerning access to these procedures are available in the premises and on the websites of district and city consumer advocates), in social organizations whose statutory works include protecting clients, as well as in the Arbitral Tribunal of Warsaw, i.e. Stały Polubowny Sąd Konsumencki przy Wojewódzkim Inspektorze Inspekcji Handlowej w Warszawie (the regulations concerning access to these procedures are available on www.uokik.gov.pl).

       

      • 9 Closing Remarks

      Pursuant to article 384. § 1. of the Polish Civil Code, provisions of the Terms of Use are binding for both the Seller and the Buyer.
